Legal Question in Family Law in Florida

Child Support

I live in Florida and my ex-husband just lost his job and moved to Georgia. I have an income deduction order in place for child support. If he is unable to pay the child support while unemployed, does he have a grace period where I cannot pursue the past amount in court or does he still have to pay no matter what?

Re: Child Support

Until a court orders otherwise, he still owes the money. As a practical matter, however, the amount due will just build up until you take him back to court.

When he gets a new job, you'll need to go back to court to have the income deduction order sent to his new employer and have the payment amount increased to make payments on the back support he'll owe you.
