I live in Florida. WHen I had my son I was marriewd to another man but he is not the bioogical father. Since I had a restraingin order on the real father he was not allowed in the hospital and did not sign the birth certificate. How do I go about adding him to the birth certificate and collecting child support.

Re: Child Support

You will have to prove paternity in court. Good luck.

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

As a result of your selfish actions, you may have hurt yourself. You will have to go to court and file a paternity action against this man and will have to submit the child to DNA testing. Had you put his name on the birth certificate, he would have had responsibility from the date of birth.

If he is determined to be the natural father, he will have the same rights to the child as you. He can file for custody and share in parental decisions. He is not only a person to pay you money for child support. If you get him involved in the child's life, he can be involved in every facet as any other parent would be.
