child support, never married

Hello, my new husband is being sued for child support. He has a son with a woman whom he never married, although she was married to someone else when the child was born. She is now married to another man and has 2 other children with him. We have always had an agreement with her and pay each month. She claims that when she went to get medicaid for the child they made her fill out these forms, and the lawsuit I received is from 2002. Why has it taken so long? Can't she tell the courts we already have an arrangement? And can they garnish my wages being the new wife?

Keep your income separate and you will have no problem since you are not responsible for the child support. Your husband is.
