I have tried to have child support modified retroactive 2005-2010 because I was in and out of the hospital and not working and so lost in illness did not file to modify to $0 income at the time. They are taking 1/4 of my income for arrears right now. It is a hardship for my current family of 4. The judge cited a case where the man was in prison to justify his denial. Disability awarded me for the 4 years in question, proving I was disabled and not working. I am wanting to try again but feel there must me something I don't know to defend my position.

Not sure what you are asking. However, if this is to dismiss the child support - that will not happen. If the amount could be lowered, the is possible. Take your paperwork to the Child Support Enforcement Division, show them your disability during that period of time and have them reassess the amount actually owed with your income and the other parties income during that period of time. If your illness was due to drug dependency, suggest you get an attorney as this may be more complicated to justify
