Legal Question in Family Law in Florida

Child Support - Mother Lost Job While Waiting On Court Appearance

I divorced Nov 2000. We shared my son week by week and I paid no child support. He is legal school age and my ex is the custodial parent (as of Sept 2002).This arrangement was set-out in our Divorce papers. We have a court date set for Jan 2003, to instigate child support. The papers we send included her earnings and mine. NOW she just lost her job. If she is still out of work at the court date, will that mean that I would pay a different amount of child support (lower, higher etc).

Re: Child Support - Mother Lost Job While Waiting On Court Appearance

Since she lost her job, there is a potential that this will change the computation for child support. However, this may be a temporary thing and the court could consider her wages over a period of time and what she should be making (i.e. imputed income).

Good luck.

Sincerely,
