Legal Question in Family Law in Florida

Child Support

I had an order from NYC for support, the order was closed but my xwife went to court here saying it was in effect and now they are still taking out the NY amounts+COLA. This has placed a huge burden on me because I make less money now than in NYC and have 4 dependants that reside with me. I am in dept because of this, I can't even afford to lose work to go to court, and the times I did It was basicly biased towards the xwife who has a court appointed lawyer (through DCS). There have been hearings that I wasn't even told about, and this is not fair. I need help bad, I cannot even afford to put fuel in my car to get to work, and many of my bills are overdue. They have also stated that I owe arrears, which are WAY over what i calculate. please help me and my family, I am a responsible person and have been making regular payments for over 4-5 years including maintaining medical and dental insurance for everone (since I moved here from NYC). Another problem I have is that she transfered the case to Ft Lauderdale and I live in Orlando, I cannot even afford to take off a whole day to go to court or the fuel to drive down.. please help..

Re: Child Support

If you don't qualify for legal aid, you may qualify for a pro bono attorney. I would also contact the Broward County selfhelp center or the judge's judicial assistant. Judges in large circuits sometimes have an assistant assigned to pro se people (unrepresented people) and can guide them as to what to do and how.

The amount of arrearage is probably augmented by interest that is added to what was owed.

You will need to have your case heard by the court in Ft. Lauderdale. If you cannot appear in person, you can write to the court and ask the judge for permission to appear by telephone. Most times the court will agree. You should try to get assistance from legal aid or some other government sponsored legal help program. Your ex will be helped by the Attorney General's office in Broward County, Florida.
