Legal Question in Family Law in Florida
Child Support
Parents sign a stipulation agreement after divorce, transferring custody of the minor children to the other parent. Stipulation states that wife does not have to pay child support. Wife's only obligation is cost for visitation expenses. Can husband, who signed stipulation, take wife back for unpaid child support under the theory ''Casbar v Dicanio, 666 So 2d 1028 (stating that when parents attempt to contract away the rights of a child, such contracts are void and unenforceable as contrary to public policy).
