Legal Question in Family Law in Florida
Child support requirement
My daughter is 19 and has been enrolled but not attending school since 6/2006. Am I within my rights to suspend child support until I get proof that she has been regularly attending? The decree says it is due after 18 yrs of age ''while enrolled in and attending secondary school on a full-time basis''. The modification says it is due ''until child completes or leaves secondary school'' if she is over 18. It is a ''home-school'' arrangement and she has turned in work once between 6/06 and 5/07 and the school dropped her twice for not turning in sufficient work. She has a history of truancy (w/court involvement) and is gainfully employed. What should I do?

Re: Child support requirement
More facts are needed to answer your question.
Is she still in high school or is she in college? If she is not in high school, what type of legitimate "home school" program is she attending? If she is not attending, then getting proof should be easy to do.
If your daughter is disenrolled or not attending in accordance with the "school's" guidelines, then you may be able to get out of the child support. In the meantime, you should keep paying in accordance with the court order.
