Legal Question in Family Law in Florida

Child Support

I have a temporary order signed in Aug. after an emergency relief hearing. In my divorce order it states my ex is to pay child support after 5 years. That 5 years was up Feb.1 2007. It took me over a year to have him served d/t evasion. Am I entitled to ask for the 16 months back child support when I go to modify to a permanent order? He has an attorney. Do I have to serve him again and if so, am I entitled reimbursement for my expenses?

Re: Child Support

He should have to pay the 16 months back support - as that was part of the original order. You are probably not going to get reimbursed for your expenses, but the judge may grant that relief if he finds your ex in contempt.

Good luck!
