Legal Question in Family Law in Florida

child support/settlement payments in arrears

My ex doesn't collect a ''paycheck'' as he does independent/consulting business. He is listed as CFO or VP on several corporations, but owns nothing ''on paper''. I don't know if having his wages garnished is something that I can do...but I have asked him repeatedly for back payment and he does not respond. I am about to go into forclosure due to his non-payment of support and settlement money.

Re: child support/settlement payments in arrears

You need to petition the court for an Order to Enforce the Child Support. This is provided you have a court Order issuing it.

If garnishment is not an option, the court may require payments be made to the court registry. If he misses payments a warrant can be issued for his arrest, his Drivers' License could be suspended, and other "fun" court imposed sanctions could be issued.
