Legal Question in Family Law in Florida

My child turns 18 in sept 2011, but will not graduate high school unit 2013 when she is the age of 19. Dose child support continue past 18? The law reads that child support shall continue if the child will graduate BY THE AGE of 19. So since she will clearly still be in school after she turns 19 should it stop?

Based on the facts in your inquiry, you should review any court order regarding dissolution including marital settlement agreement. If such document doesn't clarify the provision and only the state law applies, the support could terminate if the parent paying the support prefers to adhere to the law and pay only what is required.

Depending on the age your child will be at graduation. If child will be 18 in September - and school ends in June that would be the Junior year. Then school begins in August of 2012 and ends May 2013 - child graduates - looks like you are in compliance with the law. If the spouse causes a problem, go to court as he too will have to go to court to stop the support
