Legal Question in Family Law in Florida
child visitation
My wife and I separated on 27 dec 08, and she moved in with her father with my 3 children. After receiving threats from her father and not being able to see my kids (I was the primary caretaker) I went to their new school in a different county, was by school officials as I wasn't on the emergency card (she filled out I could not visit with them at thier lunch time. Almost immediately their maternal grandfather showed up and reiterated I wasn't to see the kids. I immediately went to the nearest sheriff substation, and after being thier several hours I was told I was being arrested for trepass on school grounds and had to spend the night in jail before being bonded out. There are no rulings as to custody of the children and divorce proceedings have yet to start. Is this not under the category of FS 787 and is this not parental interference by her father?

Re: child visitation
No. You will need a court order for visitation and joint custody.
