Legal Question in Family Law in Florida
Childs father trying to convice child to move
My childrens father and I have been divorced for over 9 years. My daughters are 10 and 12. Their father has not seen or spoken to them in about 8 years. Last year, after many questions from my children, I found their father and they wanted to talk to him. They have talked to him several times in the last months and wanted to go to see him in FL (I live in AL). All of my family lives down there also. My kids have been there for a week and a 1/2. He has told them that I have never sacrificed anything for them and that I kept them from him. That he tried to make our marriage work and I left him. He was not ready to grow up and be a father, and I had 2 kids to raise. He has also told my oldest that he wanted her to live with him and that he would take me to court and take her from me. What rights do I have? Is there anything that I can do? I am planning to go and get my kids from there as soon as I can afford it. Which will be in the next week or so. Also he is $22,000 behind in back child support.

Re: Childs father trying to convice child to move
He would have the burden of proving in court that he should have a change of custody, that would be a heavy burden given he has not been in their lives and failed to pay child support. You could hold him in contempt for failure to pay child support and should file a claim in the court where you received your divorce decree.
