Legal Question in Family Law in Florida
My childs father is trying to get visitation rights to my son. I live in Florida and he(childs father) lives in Georgia. He has not wanted anything to do with him and the door has been open for 4 years for him to do so. He and his girlfriend has been sending arguementive emails and slandering me on the facebook/myspace. rying to get out of childsupport.. He has said he wanted to sign over rights. And since I didnt drop the childsupport he is mad. My question is.. He said that he was drawing up papers for visitation, and other things. Meaning either visitation or no childsupport. Does he have to come to Florida to petition the courts or can he do it in Georgia?

He could do it in either State. However, it probably makes more sense for the case to be litigated in Florida. If he serves you with any papers from GA, I suggest immediately thereafter retaining counsel in Florida, and have him/her schedule a U.C.C.J.E.A. telephone conference between the parties, Courts, and counsel. This would have to be done before you file any documents in the GA case.
