Legal Question in Family Law in Florida
childs welfare
My son lives in florida with his mother neither one of us has physical custody through either states courts. recently I was informed by family members that she is not doing well and maybe under the influence of drugs. She doesn't inform me of there living conditions or when she moves, and right now I have no idea where they are in Florida. So what if any steps, could you direct me in?????
Thank you

Hire an investigator.

This is obviously a difficult situation for you to be in. The first issue to be sure of is jurisdiction. Will Maine or Florida Courts hear the case? The answer is that jurisdiction in a Parental Rights & Responsibilities matter is usually in the state where the child lives, if it has been at least 6 months. Since there does not appear to have been a matter previously commenced in a Maine Court, Florida seems like proper jurisdiction.
Unfortunately I do not practice Florida law, but assume that if you can locate them, you can commence a child custody matter to protect your child from the dangers you suspect he/she is being exposed to. Contacting Florida counsel may be your best bet.
