My soon to be exhusband filed a petition for custody of our 2 minor children while they visted him on the holidays. He was watching them one night, and now refuses to let me have them back. I have been the sole provider and custodian since birth. He has provided no substantial support since they were born. I am a lesbian and planned to move to another state with my lover of 2 years. I feel like this move would help me better my childrens life and mine as well. He lives in Florida and I reside in Georgia with the kids. I plan to move to Arkansas. My children have met my lover and are excited about the idea of moving closer to her and her son. My ex disagrees because he feels like I should make the children and myself available for when he is ready to interact with them. He lives with a much older women and has been on his job less than 3 years. The petition he filed is full of false statements and information that i can provide strong evidence against.He has been abusive in the past and cheated the entire length of our marriage. I would allow visitation with guidelines and help with travel expenses, but I have to do whats best for my children, not him.His actions are to hurt me and not because of his concern for the children.

You didn't give enough facts to give you a decent answer. I would first like to know where the divorce was granted. Consult with a local attorney.
