Legal Question in Family Law in Florida

Choosing Daycare / Schoolfor child

In the agreement for shared custody of the minor child my husband and his ex agreed that all decisions reguarding, education, health, moral issues would all be agreed upon. The child is 2 1/2 years old. She has repeatedly moved him from daycare to daycare every few months, when she is questioned reguarding his well being. She now has him being babysat by her friend. She says will not put him back in a daycare facility. That she doesn't have to consult him about it. All drop offs and pick up are supposed to be from school. Is she in contempt of court by refusing to put him in a daycare that they both agree upon? My husband does not feel like the child will be cared for by her friend that is babysitting him.

Re: Choosing Daycare / Schoolfor child

If the agreement requires agreement rather than consultation on all decision, then the ex is in violation of the Agreement/Final Judgment. Your husband's recourse in this situation is to file a Contempt of Court action against the mother.
