Legal Question in Family Law in Florida
who claims the children
I split with my ex-boyfriend over 3 years ago who we have two children together. He visits them every other weekend and pays $50.00 a child a week. He owes almost $4,000.00 dollars in back pay and is $700.00 behind in regular child support. My question is, who is entitled to claim the children on their taxes? We have no written agreement or court order. Thank you for your time.

The test the IRS uses is the person who provides over half of the child's support during the tax year may claim the child as a deduction and that would seem to apply as you indicate there were no other arrangements.
