Legal Question in Family Law in Florida

The company that I work for is closing its doors 01/31/12. I pay monthly alimony. I have also remarried. Can I get my alimony modified? Can my X husband go after any of my new husbands assets? If I can't pay my alimony, I know I will be in contempt of the court order. Will the courts take away my drivers license or put an arrest warrant out on me?

If you have a change of financial circumstances you should petition the court for a modification of alimony. Your husband's assets are not available for your alimony payment.

It would be good for you to Petition the court ASAP and bring with you the information as to the store closing. As to your new husband, his assets are not counted for your alimony payment.

I agree completely with both Ms. Becude, and Mr. Slater's responses. I would add that you should promptly proceed since the Court will not give retroactive effect to a Petition For Downward Modification.

If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a do over if things go badly.
