Consent to Adopt?

My oldest son is 13 and his biological father is not in his life. He has been in and out of prison for the last 13 1/2 years. My son is 13 years old and has only seen this man maybe 6 times. He has not seen him in several years. My question is, since he is currently incarcerated again, and my husband wants to adopt my son, how do I go about having him sign off on the adoption? Do I have him sign a paper consenting to this, then go through a lawyer for adoption or must I go through a lawyer first? My husband has been in my son's life since he was 3.5 years old and my son loves him dearly. Thank you for any advice you can give.

Retain counse, since a court proceeding is required.
