Legal Question in Family Law in Florida

I have had no contacted with the other party of this since 2002. I have no clue where this person is and I want a divorce. I should I go about getting?

You will go about filing for a divorce just as any other party to a divorce. The only difference is that you cannot personally serve him the papers (or have it done by the sheriff or process server) so you will have to use constructive service (i.e. publishing in a newspaper of wide circulation in the location that you think he may be in). However, you must perform a diligent search and inquiry for him.

You can file for a divorce with notice by publication. This is a process that allows you to provide notice to the individual by filing a ad in the newspaper. Please note you can only get a divorce this type of proceeding will not award you any property or decide any custody of children. You can find the forms for this at flcourts.org.
