Money earned during the marriage is clearly marital. If you are frustrated by his refusal to work, then why are you staying with him? Assuming the marriage is over, your best bet is to divorce him sooner than later. If you have been married for at least 7 years, he might be able to try for durational alimony (capped to the length of the marriage). If you have been married for at least 17 years, he might be able to go for permanent alimony.
