Is she correct with her threats?

My friend is going thru a divorce and is dating someone. He & his wife have been living apart for 3 years, she asked him to leave. Now she wants him back but he's happy in a new relationship. She is threatening him w/ saole custody of their daughter & limited visitation b/c she found out about the relationship. Can she drag this out as long as she wants & do these things to him?

Hello: Your friend can file for the divorce as soon as he wants. The court controls the pace of the case even though the attys may ask for extra time to do their investigating and preparation for trial. Most cases settle at mediation before trial. But she can't do anything to him because she is upset he is dating someone, nor can she drag a case out. 'Hope this helps. Tom Rosenblum
