Legal Question in Family Law in Florida

I am going to court in January over child support. My son has had an individualized education plan since he entered school. He is now the first semester of his junior year and is working at a 7th grade education level. His IQ has tested out between 68 and 78. He turned 18 Spetember 9, 2012. I am trying to get a continuance of child support. My ex does not visit with his son on scheduled visitations anymore. He get him every other Saturday and returns him Sunday. So he stays with his dad two nights a month. What do I need to present in court to get the judge to order a continuance of child support but at an adjusted amount to cover the time his dad is failing to get him?

Under current Fl law support will end no later than the age of 19, however if the child is special needs and is permanently dependant on others for survival then you could make the case to continue support beyond that age. Contact my office for free consultation 727-446-7659
