Custody Agreement filing

An attorney is preparing a custody agreement for me and she said it doesn't have to be filed with the court since me and my ex are agreeing to the terms. Is this correct? If yes, how would it be enforced if it wasn't filed?

What would it get filed in? If there is no divorce pending or any other court case, there is nothing to file it in. It is enforceable because you both sign and agree to the terms just like a contract. Most contacts never see the inside of a courthouse, only the ones that need to be enforced.
