Legal Question in Family Law in Florida

I was given custody of my child in new york and the father was given visiting rights...which he doesnt even excercise. I found a better life for my child in Tampa, Florida so I decided to move from state to state. Now the father is taking me to court for violating his visitation rights and is requesting that the court make me relocate back to New York. Can the court MAKE me move back to New York?

I assume he filed his motion in New York, which means you'd have to ask a New York lawyer.

If he filed his motion in Tampa, the answer is probably yes. Florida law prohibits you from moving a child away from the noncustodial parent, but you wouldn't be violating Florida law, since you moved away from New York, not Florida. If your case is filed in Tampa, you should call or email me right away.
