custody

I'm going to court this month, with the recent changes in the law, what are the chances of winning a 50%-50% visitation in the State of Florida?

It's a myth that Florida law changed to make 50/50 custody more likely. The law only changed to make it clearer that parents have equal control over the kids, not equal time.

Still, over the years, judges have been more and more likely to award 50/50 custody (we call it "rotating timeshare"), despite the fact that appellate courts don't like it. To get 50/50 custody, you have to prove things like:

1) you and the other parent get along very well,

2) both parents truly have the best interest of the kids in mind,

3) the kids can handle the constant switching back and forth,

4) the kids get good grades,

5) you don't want 50/50 custody just to lower child support, and

6) both parents live pretty close together.
