Legal Question in Family Law in Florida

Although the custody isn't in dispute I wanted to file form 12.902 (d) under the Florida Child Custody law. The instructions are easy to follow but my problem is....I can't locate the Father to serve him with a copy. He left his job and I don't have an address or phone number. He walked away when I was six months pregant and might have left the country.

This document should have been served on him with you filed your original petition. You should file a notice of action in the county where he last resided and then forward this form to the place he last lived. This may not qualify as due diligence in trying to locate the father. If you can not afford an attorney, you might want to see if you can qualify for legal help with one of the legal aid offices in your area. Anytime you are dealing with children in a family court situation, it is best to have an attorney represent you.

There is also the question of paternity. Did you add his name to the birth certificate/have you filed the correct documents to establish paternity/child support?
