Legal Question in Family Law in Florida

custody

my husband divorced me secretly by stealing my notice of final hearing out of the mail. I found out after the fact. for the past year we have been going back & forth in court and he now has full custody of out children (12&5). my 12yr son & daughter have told me of sexual & physical abuse but child protection svcs refuse to listen. there has never been a custody hearing. How do I file a motion to force the issue of custody to be examined. I have a lawyer of record but he will not even return my phone calls, emails etc. He has dissapeared & I need to do something. My children are begging me to get them away from their father.

Re: custody

It is possible solution to set aside the judgement if you can argue this based on your not receipt of the notice of hearing. If you need help e-mail me your phone # to discuss further.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You have made some serious allegations in your question. If only half of that is true, then you truly need counsel to represent you and guide you in handling this matter in order to safeguard your children. This is frankly way too difficult for you to handle on your own and nobody can explain it to you in a paragraph or two.
