custody

can a maternal grandma that had legal paperwork for grandchild everytime mom went overseas keep custody of child & go to court for rights even though dad is living and only saw child because the mom made him visit & spend time to honor the divorce decree.He saw her 1/2 summer & some holidays & even while mom went overseas he never made a effort to get her any extra. What does the grandparent need to do if anything to keep her custody or can she ?

The Grandparents rights laws in Florida have been strucked down as being unconstitutional. If a contest were to develop between the father and the grandparents, the father would likely prevail. Mother's preference would not decide the matter.This probably requires the Grandparents maintaining good relations with the father.
