I am in the midst of a divorce and my wife & I have agreed on 50/50 custody of our child. I have a girlfriend, & have provided a clean criminal background check on my girlfriend to my wife. She is now requesting a ''right of first refusal'' that she (my wife) be entitled to watch my child, while she is in my custody, and I am not able to watch her, instead of my girlfriend...for instance if I am working, or at church, instead of having the child go to youth church. I have allowed and encouraged my girlfriend to watch the child and my wife has expressed that she wants to meet my girlfriend, but refuses to commit to a meeting time or place. My question is, Can I legally have my girlfriend watch my child, even though my wife has not yet met her, and wants to watch the child herself? And what grounds does she have to enforce a ''right of first refusal''? Under these circumstances, I do not even understand the law on the ''right of first refusal''. I would appreciate any information you may have regarding this issue. Thank you in advance for your time and assistance.

That would impose a considerable burden on you and if you don't want to agree, don't -- let the court decide. You should seek advice from a local attorney.
