custody procedure
In a custody case in which the child lives with the mother and the father pays child support the father requested visitation rights. The mother counterclaimed and it has not been presented in front of a judge. Are we waiting on the judge or is there something we should be doing. A petition we must submit?

If it is not a part of the custody case already you can file a motion to establish visitation; although that should be considered in any event. I don't understand a counterclaim-to what? The fact that you want visitation? If she has custody already and child support is ordered, there should be nothing to counter-claim about. The facts you submitted do not indicate any.
