How do i get custody?

What is the process to recieve full custody of my daughter from her unfit mother?

Hey. I saw your question and the one response. I'll add another . If you want, get on the internet, check Florida Statutes. Section 61.13 lists some of the criteria a court must take into consideration to determine which parent is best suited to be the primary residential parent for a minor child. First, the moving party has to file a Petition (this assumes there has already been a ruling in a divorce or paternity case). You probably should have an experienced family law atty. represent you. These are important cases and there are a lot of strategies and tools we use. The court will order a child custody evaluator to investigate the case, meet with the parties and any witnesses and render a report with his/her opinion on who should be the residential parent. The case will go to mediation where a mediator will meet with both parties and try to settle the case without a trial. If it doesn't settle, a trial will be held in front of a judge.

Depends on your ability to prove the unfitness of the mother. Assuming there is no action filed yet, there are different criteria for a divorce case and a dependency case. A good family lawyer in your area can advise the best route.
