Custody of my son
I have a 16 month old son when he was 2 months old I filed for child support. I only received one months payment in the month of Feb.,2006. My question is the father doesn't visit or play any role in my son's life doesn't contribute to any financial services for him or try to see him on any occassions. But he refuses to sign over his rights as a father. Is there any law or any thing at all that I can do to ensure that a year or so from now when /if he decides to play a role in his life that he can't just take my son? I hear so many differant stories about what he legally can and cannot do I just want to know the truth. As far as child support I would rather do it by myself and not have to worry about his threats if him not paying keeps him out of my and my sons life.

Petition the court for sole custody.

As long as it is not against the child's best interest, the father is entitled to being a part of the child's life. However, I would not give up my rights to child support. One has nothing to do with the other. He is entitled to visitation and you are entitled to child support. Why not enforce the judgment you already have...
