Legal Question in Family Law in Florida

custody

my 15 years mother was arrested for dui/vehic manslauter yesterday. she is currently with her aunt. it seems i may have trouble getting her from there. neither the mother nor myself have ever filed for custody. however i have been paying childsupport(does that mean that she has custody?) i have been very active in her life. she has lived with me on 2 seperate occasions for the school year, and has spent countless nights, weekends and summers How do i go about getting sole custody or legal custody? not sure the difference. PLEASE HELP!!!

You need to obtain a court order granting you custody.
