Dating and Divorce

If someone has been separated fromtheir spouse for over a year and a half, when thay go to court to file for a divorce, do the courts hold it against you if you are now currently dating someone?

There is no problem if you want to date while a divorce is ongoing. This fact can not be used against you in court unless you are not using good judgment in front of your children (if any) regarding sexual behavior. Discretion is definitely a virtue. Florida is a no fault state and the Court will generally not even listen to any issues regarding cheating, affairs or the like during the course of the marriage except if the other spouse can show that marital assets were dissapated as a result of this illicit relationship.

I strongly suggest that you consult with a family attorney to discuss any and all questions prior to your final hearing.

No, under no-fault divorce, such condition do not affect the divorce unless there is some effect on parenting or child support.

Discretion is always best. Wheather to keep things "friendly" while negotiating a settlement or to avoid entanglements with child custody issues. Generally,, "dating" has no bearing on divorce issues.
