Legal Question in Family Law in Florida

When my daughter was born I was seperated and dating someone else at the time. I had a C-section and was incoherant most of the time afterwards. My boyfriend at the time filled out most of the birth certificate and checked that I was not married and my boyfriend was listed as the Father. My husband and I have resolved our differences and have decided to stay married. I know by law in Florida if youa re married your husbands name MUST be on the birth certificate. How do i get my ex boyfriends name off the birth certificate and my husbands name on it? My ex has nothing to do with the child in any way shape or form. once I decided to stay with my husband he moved, changed his number, and did away with all contact.

The law doesn't require that a husband's name be on the birth certificate, but the law does say that the husband is the legal father (unless the husband decides otherwise). Have you tried filing for an amended birth certificate with the Department of Health?
