Legal Question in Family Law in Florida

My daughter in Florida, had a baby 2 months ago.She is not married to the baby's father but his name is on the birth certificate. She has filed for child support and she is still waiting for the paperwork. In the mean time, is the father obligated in any way financially? Can I, the grandmother, take him to small claims court to recoup all the monies I have paid to date for supporting his child?

If the child is his, then he has an obligation to support the child. When child support is calculated, an arrearage will also be established going back to the child's birth. Any payments he makes will be applied to that arrearage.

If your daughter has applied for child support through the Dept of REvenue and has not heard anything yet, then she needs to follow up with them. Remember that even though he must pay child support unless he files for visitation - he will not have any rights to this child.
