Based on the literal facts described in your inquiry, the conduct is abusive to a child, and if permitted by the mother, she is also subject to charges of abuse. The conduct is an issue considered by a court when deciding custody issues. A court will also consider testimony of a 13-year old child in such cases. A family law court will focus on the best interests of the child. If such abusive conduct is repeated or continuously threatened, the conduct is subject to serious consequences. If you consider the situation to be continuing, you may consider discussing with Children and Family Services, local family law organizations, or a family law attorney to consider legal options, including formal complaint or legal action.
