daughter

i have been seperated from my husband for 7 years. we live in two different counties there are no legal papers could i move out of state. with my daughter.

You are the residential parent I take it. The child is with you so you have control.

It is hard to tell from the limited facts but, if he cares enough to want some visita, you ought to make some arrangements for visitation.

If you've been separated for 7 years, may be he doesn't care what you do.

If he doesn't care, then he should have no problem agreeing to a divorce and you having full custody in another state. If he gets difficult, threaten to force him to pay child support, if he isn't already. Then once he's agreed, make him pay child support.
