Legal Question in Family Law in Florida
My daughter's father and I have never been married. He recently wanted to go through the courts to have court ordered visitation with our daughter now that she's almost 14. He is now married and my daughter hates visting her father, more so now then before. Is there anything that can be done to stop the court ordered visitation? After almost 14 years he JUST started paying child support via court order January 2011. (i've NEVER asked him for anything) He is in arrears over $50,000.00. I've never been on public assistance, I've raised my daughter on my own and now he wantes to come in and play dad.

Your situation as described in your inquiry is difficult but you have some advantages. Your record as a parent deserves praise. Most important legal advantage: if your daughter is a reasonably mature 14-year old, a family law judge will listen to her wishes and opinions and will listen to court-appointed or other child psychologists who will advise the court regarding any visitation. Your daughter's father has many issues: lack of child support during her formative years, lack of close contact with your daughter, and most important, an apparent unwillingness of your daughter to participate in such visitation. It appears the father may have to earn some of the respect and affection which he may think he deserves. You are advised to seek counsel from a local family law attorney who can discuss the issues with you and represent you in arranging some kind of visitation agreeable to you and her father, but most important, acceptable to your daughter.
