my daughters mother died and she was married to another man and he has my daughter can i legally go get her or do i need a court order

It depends. Are you listed as the father on the child's birth certificate. Did you establish paternity prior to this point? If yes then you can get your child with a court order. However I'm assuming the step father has a issue with this. Then you may need court intervention.
