Legal Question in Family Law in Florida

Be Gone Dead-Beat Dad!!!

Is it possible for me to somehow force my daughter's father (who is NOT paying child support) to sign over his parental rights so that my new husband can adopt her? And since he's not paying any form of child support am I required to allow him visitation.

P.S. We were never married.

Re: Be Gone Dead-Beat Dad!!!

You can not force your daughter's father to relinquish his parenting rights. However, depending on the facts of your case you may not need his consent. I would need more information to make a final determination. My question to you is, Why are you not going after him for non-payment of child support? You should file this action immediately. Finally, you can not refuse him visitation even though he is not paying child support, that is the law. Therefore, you should definitely file an action for his non-payment of child support. I would be happy to discuss the issues of adoption and contempt further. Sincerely, Melody Stickel-Martinez, Esq.
