Legal Question in Family Law in Florida

Dear People,

My father died 28 Dec 2009. He was living with my brother; however, kept his own finances via SS & interest on the principle from the sale of his home. He told me he never touched the principle, because he & my mother wanted to leave us kids something. My brothers were made executors of his acct.; however, he stated to me that his home sale was set up @ Wells Fargo & was to be divided equally 4 ways (myself & my brothers to inheritate equal amounts of the home sale principle. On this, my father stated to me that this was all taken care of & we'd all get 1/4 of the amount. Today is 27 Feb 2010 & my brothers haven't done ANYTHING about informing me of my share, when to expect it, etc. Every time I've tried to get dates, etc. from him, he starts making excuses about everything. At this point, I'm not sure what he's doing or when he'll begin taking action. It feels like he's side stepping me even though I never would have believed he of all my brothers would do this to me, his only sister. I feel desperate & lost about what to do. Can you help/advise me on what action to take? Please help me. I greatly appreciate all you are willing to advise me on. Most Respectfully, Sharon Cummins

go to the courthouse in the county to which your father died. See if there is a probate case on file, if there is a will at the court house. If not, then get copies of the death certificate, get an attorney and file for probate. Your brother will be made to account for the assets that your father left.
