Legal Question in Family Law in Florida

Death of will executor who has children

My children's father was the executor of his father's will, but died before his father. Who becomes the executor now if there's no sub-executor named? Does it automatically go to the children of the named executor or is it open to any family member?

Re: Death of will executor who has children

Hopefully the Grandfather has named a successor Personal Representative in a revised will. If not, The executor of the grandfather's will could be any beneficiary who petitions the Probate Court to be awarded that authority when the will is probated. If multiple beneficiaries wanted to be the Personal Representative, the Probate Judge would make a decision.
