Legal Question in Family Law in Florida

Debt responsibility after filing

Scenario : A and B file for simple dissolution and after the date of filing A incurs debt. Would spouse B be held responsible for A's debts and if B could be so held are there any means by which B can be protected?

Thank you.

Re: Debt responsibility after filing

It depends on, for one thing, what the debt was incurred for. It may still be considered a marital debt for which both parties may be held responsible. This is a very general response to give you some answer to your first question. As to the second, the best way to protect yourself, other than closing joint credit card accounts, etc., would be to enter into an agreement with your spouse concerning the handling of finances/debts occurring after the date of filing.
