Legal Question in Family Law in Florida

My ex has decided to sue me for breach of contract over our seperation agreement in civil court. I have plans to move out of the state of FL in June. How will this affect me? Also he too is in breach of 3 different items in that same contract. How likely is a judge to throw all of it out (both sides)?

You will need an attorney to analyze the strength and weaknesses of each position.

If you intend to permanently move more than 50 miles away from where you are currently and there are minor children involved in the separation agreement pending before the court or the issue as to how each of you should spend time with the children has already been decided in family court, for you to relocate- you must either obtain written permission from your ex and ratification by the family court or you must file a petition to relocate.

Not sure if the courts will allow this. First there are no separation agreements in Florida. The fact that you have one between yourselves may be a civil issue and not a family court issue. You need to have the agreement reviewed to see where each of you stand. The fact that you both broke the agreement - the agreement may be null and void.
