Legal Question in Family Law in Florida

the dept of revenue represented the child in a support hearing, bit the opposing attorney told the judge that support was established in a previous hearing and the judge dismissed the case based on what the opposing layer said. the letter received about the finding says a modification must be filed to over turn the judges dismissal. now comes the quagmire. at no time did a judge give a support order - non exists. the dept of revenue won't return my calls, i cannot afford an attorney and the support office says i can only file (not ask for a modification because a support order does not exist) a new case at revenue. from the passed experience with revenue non paying father in this case it would take well over a year. I am the 77 year old guardian in this florida case, can't find a job and really need the support monies for my grandson and me. also, we have moved to the other side of the state. revenue here will not open a new case where we now live and revenue does not return my two weeks of calls from where i originally filed for support 3 yrs ago. the father ears in the low 6 figures and bragged to me that he spent 30,000 to fight support and he won beause his lawyer lied, the judge believed the lie and revenue didn't do their job, what do i do now????? we really need the support this child is entitled to.

If we can prove the father makes what he claims, then I might be willing to undertake representation at a greatly reduced retainer, and attempt to have the judge Order reimbursement/payment from the father. What did the father claim his income was on his financial affidavit? Does he work for himself?

A Motion for Reconsideration, and/or for Rehearing should be pursued. As you won't get a 2nd chance at this, have an attorney do it.

If the Dept. of Revenue is too slow, which they are, and it is a DOR case then you have to meet with them to get the case moving, or in the alternative you can file the case on your own with or without a lawyer.
