Dont deserve to be part of .....

I have been seperated from my first son father for 12 year , he just started paying child support for 3 years! I remarried 9 years ago and my husband takes care of his medical, food shelter,love everthing that a father does for his child. my son boldly told his dad that he wants his stepdad to get custody of him and stop paying him only 40.00 every 6 month or every other. i want my husband also to take custody . he is basicly a dead beat dad now he has 2 more kids from 2 other female ! the difference is that my son keeps in touch with his sibling and them too. he dont deserve to be part of my son life can my husband just take over with out the other consent? please help need advise my son dserve the best he is 13 years old

Visitation cannot be denied to a father based on child support or a stepparent's presence in the life of the child. If a judge determines that visits with the parent is detrimental to the child, then they can be terminated; not because of unpaid child support or the fact that the child has a stepfather.
