Legal Question in Family Law in Florida
I disagree with fathers lifestyle and living arrangements...
I have custody of my 4yr old. The father and I have arranged visits on our own. He is allowed to visit at any time, any day. He takes him every weekend. Over the past year, his father has entered a relationship I do not agree with. He is sexually active and living with a 16yr old. He is 29. I have been told there is nothing I can do as far as legally turning this over. Over the past few months, things are really difficult. I asked for 1 hour over Easter weekend to have my son with my family. He refused saying it was HIS weekend. I NEVER have a weekend! He brings him home late (9pm) on school nights. No bath, hungry etc. There's no ''set'' court ordered visits. He has become a different person mentally since dating this youngster. I've had many strange conversations with his gf, and honestly I believe she has mental issues (compulsive liar/ exaggerating story teller) My son recently told me about her slandering me. Mommy, (gf name) said you're ugly & stupid, & I can't talk about you when I'm there. I cried for you and I got a spanking. Etc...:( I'm very worried about my sons well being. His father often leaves him home alone with his gf while he works. I'm frightened over her being with my son. He's just a baby :( What can I do?

Although technically the age of consent in Florida is 16, I doubt a judge will look too favorably on this relationship, and not just because of her age. It's probably time to go back to court and get the visitation schedule firmed up, along with getting a number of other rules defined. Given the circumstances, you should ask for sole custody, meaning that his visitation is at your discretion.
